Legislative basis for CCAM testing

Traffic on public roads and roads open to the public is governed by the provisions of this regulation. The provisions of this regulation address the owners, keepers and drivers of vehicles or animals, the persons they transport, as well as pedestrians, whether they are moving or stationary. In the context of scientific tests (such as autonomous driving vehicles), this regulation includes certain provisions that allow for vehicles designed according to new techniques or principles that are not regulated or are incompatible in nature with the provisions of other articles of this regulation to drive under a special authorization issued by the Minister for Mobility and Public works. Furthermore, the driver of such a vehicle can be exempted from certain provisions of this regulation, also under the aforementioned special authorization.
Application Requirements
No application form available, individual application necessary.
An application must be addressed to the Minister for Mobility and Public Works. The application must contain a description of the technical details of the vehicle, the route where the tests are being conducted, the insurance for the vehicle and the registration of the vehicle.
List of requirements:
- Completed application form.
- Insurance for vehicle.
- Registration of the vehicle.
- Description of the modifications to the test vehicle (if based on type-approved vehicle)
- Description of the automated driving function, which is intended to be tested.
- Confirmation of / information to road operator
- Performing a successful pre-testing phase on public roads with no passengers
- The driver (responsible of the vehicle) must be in possession of a valid driving licence for the type of vehicle used for the CCAM tests.
Responsible for the safety validation: Independent assessor / Technical service (by means of expert reports)
Average handling time for the process: It depends on the specific project. During this time, the different documents are being analysed by the different departments of the Ministry for Mobility and Public Works. The duration for authorization process from the municipal side cannot be influenced by the Ministry for Mobility and Public Works. The experience from past projects shows that also the necessary authorizations from the municipal side can be granted within the 2 months.
Application fee: Not required.
Is a test permit issued by another country accepted? Ongoing coordination between the respective Ministries involved.
Conditions for Testing
Vehicle categories: Cars, Trucks, Buses, Shuttles, Small urban goods delivery vehicle robots
SAE levels: No limitations.
ADAS / AD systems: It is allowed to test all ADAS systems on public roads.
Use-Cases: No limitations.
Geographical areas: Limited to specific areas defined by the government.
Permit validity: Generally, a test permit is granted for 1 year, which can be renewed at the time of expiration, following a request by the applicant.
Driver Requirements
Safety driver: Always required.
Remote operation with no safety driver inside or in sight of the vehicle: Not allowed.
The driver (responsible of the vehicle) must be in possession of a valid driving licence for the type of vehicle used for the CCAM tests.
Data Requirements
Black box needed: Not mandatory.
Obligation to report to authority during/after CCAM tests: Not mandatory.
Test reports availability to the public: Not available
Obligation to report to authority in case of accident: Not mandatory.
Any other supervision / monitoring performed by the authority: No
Requirements on data recording: No specific requirements.
Requirements on disclosing data during/after tests: No specific requirements.

Cross-border CCAM Testing
On the 14th of September 2017, the German, French and Luxembourg governments signed a joint agreement concerning the establishment of and cooperation around a common digital testbed for CCAM. This agreement affirms the common desire of the countries to promote the development and experimentation of connected and automated driving technologies in a real-life cross-border environment. This experimental site enables industry and research to test innovative technologies on all road categories (motorways, departmental roads, urban roads), while providing a framework to exchange on the experiences regarding legal, social and technical issues encountered.
Notable EU-funded projects on the testbed include:

While several others (e.g. ConVex, KorA9, etc.) were performed in the presence of the respective Ministers during a dedicated project day.
